1. Definitions
For the purposes of these Terms:
- "MeghQuasar", "we", "us", or "our" refers to MeghQuasar, an independent air mobility facilitation platform.
- "Client" or "you" refers to any individual, organisation, hospital, or entity requesting or using services through MeghQuasar.
- "Operator" refers to a third-party aircraft operator holding a valid Air Operator Certificate (AOC) or equivalent regulatory approval.
- "Services" refers solely to facilitation, coordination, and support services provided by MeghQuasar.
- "Flight" refers to any air transport service operated by an Operator, not by MeghQuasar.
2. Scope of services
MeghQuasar provides facilitation and coordination services only.
Our Services may include:
- Intake and assessment of client requirements
- Identification of suitable third-party Operators
- Coordination of communication between Clients and Operators
- Assistance with documentation and scheduling
- Technology-enabled workflow and coordination support
MeghQuasar does not:
- Own, lease, manage, or operate aircraft
- Hold an Air Operator Certificate (AOC)
- Act as an air carrier, charter operator, or airline
- Exercise operational or safety control over any flight
3. Role of Aircraft Operators
All Flights facilitated through MeghQuasar are:
- Operated exclusively by licensed third-party Operators
- Conducted under the Operator's regulatory approvals and oversight
- Subject to the Operator's operational, safety, and insurance responsibilities
The contract of carriage for any Flight is strictly between the Client and the Operator. MeghQuasar is not a party to the air carriage contract.
4. Payments & Commercial Terms
4.1 MeghQuasar Fees
MeghQuasar may charge fees for:
- Platform access
- Facilitation or coordination services
- Concierge or administrative support
Such fees are payable to MeghQuasar and are separate from flight costs.
4.2 Flight Costs
- Flight pricing is determined solely by the Operator
- Flight payments are governed by the Operator's terms
- MeghQuasar does not guarantee pricing, availability, or acceptance
Where applicable, MeghQuasar may receive a facilitation or referral fee from Operators.
5. No Operational Responsibility
MeghQuasar does not assume responsibility for:
- Flight safety
- Aircraft condition
- Crew qualifications
- Maintenance
- Regulatory approvals
- Delays, cancellations, or diversions
- Immigration, customs, or overflight permissions
All such matters remain the sole responsibility of the Operator and relevant authorities.
6. Medical Flights Disclaimer
For air ambulance or medical evacuation requests:
- MeghQuasar does not provide medical services
- Medical care is provided by the Operator or associated medical providers
- MeghQuasar does not guarantee medical outcomes
Clients are responsible for ensuring medical suitability for air transport in consultation with qualified professionals.
7. Information Accuracy
MeghQuasar relies on information provided by Clients, Operators, and third parties. We do not warrant or guarantee:
- Accuracy of Operator representations
- Aircraft availability
- Regulatory approvals
- Weather or operational feasibility
All decisions to proceed with a Flight are made by the Client and Operator.
8. Limitation of Liability
To the maximum extent permitted by law:
- MeghQuasar shall not be liable for any loss, injury, damage, delay, or expense arising from or related to any Flight.
- MeghQuasar's liability, if any, shall be limited to the fees paid directly to MeghQuasar for its Services.
- MeghQuasar shall not be liable for indirect, incidental, consequential, or special damages.
9. Indemnity
The Client agrees to indemnify and hold harmless MeghQuasar from any claims, losses, liabilities, or expenses arising from:
- The operation of any Flight
- Acts or omissions of Operators or third parties
- Inaccurate information provided by the Client
10. Regulatory Compliance
Clients acknowledge that:
- Aviation operations are subject to regulatory approvals
- Permissions may be delayed, denied, or modified by authorities
- MeghQuasar cannot guarantee regulatory outcomes
11. Confidentiality
All commercially sensitive information shared during coordination shall be treated as confidential, subject to lawful disclosure requirements.
12. Termination
MeghQuasar reserves the right to:
- Decline or discontinue Services
- Suspend access for misuse or misrepresentation
- Terminate engagement where compliance risks arise
Termination does not affect accrued payment obligations.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Courts located in Mumbai, India shall have exclusive jurisdiction.
14. Amendments
MeghQuasar may update these Terms from time to time. Continued use of Services constitutes acceptance of revised Terms.
